Ask Our Attorney Mark Hedberg: Workers' Compensation and Unemployment Benefits

You may be able to collect both workers’ compensation and unemployment benefits under the following conditions:
1.      You sustained a work-related injury;
2.      You have been released with permanent restrictions; and
3.      Your employer has refused to accommodate those restrictions.
If those three events have occurred, you should file for unemployment benefits, provide a copy of the restrictions as well as any information you have from your employer stating that those restrictions will not be accommodated.
