Ask Our Attorney Mark Hedberg: Questions Concerning the Exchange of Information When Claiming a Work Injury

Mark Hedberg

By Mark Hedberg, AFSCME’s Attorney

Do I have to give the Employer/Insurer my medical records or a medical release?

Yes, though there are limitations and you have rights related to the records. Failure to provide a medical release to the employer and/or its insurance carrier can delay care or even terminate your workers’ compensation benefits.

What information do I have a right to get from the Employer/Insurer?

Copies of medical records, personnel file, payment records, wage information, etc.
